1. Agreement
Please read these terms and conditions carefully. By making a purchase or becoming a customer of AME System Pty Ltd, you indicate your acceptance of these terms. These terms may be updated at any time without prior notice. All transactions are governed by the terms in effect at the time of the transaction. These terms apply to all products and accessories sold by AME System Pty Ltd.
2. Interpretation

“AME System” – refers to AME System Pty Ltd and all its products.

“Accessories” – refers to all products listed and sold by AME System Pty Ltd.

“Customer” – the person, company, or organisation purchasing goods from AME System Pty Ltd.

“Goods” – all goods and/or services supplied to or ordered by the Customer, including those described on quotations, invoices, purchase orders, or other documents.

“Price” – the cost of the Goods, as listed in AME System Pty Ltd’s price lists, quotations, or specific agreements with the Customer. Prices may change without notice.

“Customised” – any Goods modified to suit a specific Customer, individual, or task.
3. Retention of Title

Ownership of all Goods remains with AME System Pty Ltd until full payment is received, including all applicable costs.

AME System Pty Ltd may request the return of Goods at any time prior to full payment.

Goods must be stored in a manner that clearly identifies them as AME System Pty Ltd property until paid in full.

Risk passes to the Customer upon delivery, but title remains with AME System Pty Ltd until full payment.

In cases of non-payment, AME System Pty Ltd reserves the right to enter the Customer’s premises to repossess the Goods.

Customers may sell Goods in the ordinary course of business, holding sale proceeds in trust for AME System Pty Ltd until full payment is made.
4. Orders

Prices and product specifications may change without notice.

GST is excluded from all prices unless otherwise specified.

Order amendments must be made by emailing sales@amesystem.com.au. Additional delivery costs may apply if the order has been dispatched.

If ordered Goods become unavailable or discontinued, AME System Pty Ltd will notify the Customer within 48 hours. Customers may cancel such orders without penalty within 48 hours of notification.

Cancellations outside the above timeframe incur a 20% restocking fee. Customised products are non-refundable and non-returnable due to change of mind.

The aluminium profiles products customisation feature is currently in a beta phase. By using this feature, you acknowledge and agree that:

AME System reserves the right to review, adjust, or cancel any order where inaccuracies or configuration errors occur.

We may contact you to confirm specifications, compatibility, or pricing prior to processing your order.

T-slot profiles product configurations certain options, features, or prices may change without notice as part of ongoing development and testing.

In the event of an error or discrepancy, AME System may issue an adjustment, replacement, or refund at its discretion.
We appreciate your understanding as we continue to refine this feature and improve your experience.
5. Payment

New Customers must pay in full prior to delivery unless otherwise agreed.

Credit accounts may be established after a successful transaction and credit approval.

Payment terms for approved accounts: strictly 30 days from invoice date unless otherwise agreed in writing.

Credit card payments over $10,000 are not accepted.

Deposits:
-
Orders valued at $30,000–$49,999 require a 50% deposit.
-
Orders valued at $50,000+ require a 25% deposit and milestone payments.

Overdue payments may incur 2.5% monthly interest and recovery costs.
-
Customers are responsible for dishonour fees and associated costs.
6. Delivery

Design changes requested after confirmation may result in additional charges and extended lead times.

Dispatch and delivery dates are estimates only. AME System Pty Ltd is not liable for delays.

Additional delivery charges may apply for multi-storey buildings or after-hours delivery.

The delivery site must provide clear, unobstructed access. AME System Pty Ltd reserves the right to charge for time lost if access is impeded.

Risk transfers to the Customer upon dispatch.
-
Deliveries are available across mainland Australia and Tasmania; deliveries outside these areas are ex-works.

International Customers are responsible for import duties, taxes, and customs clearance.
7. Defects and Returns

Goods must be inspected upon delivery. Claims for defects or short delivery must be made within 7 days of delivery; claims for non-delivery within 14 days of dispatch.

Returns are accepted only with prior arrangement and may incur restocking fees up to 25%.

Return shipping costs are the Customer’s responsibility.
-
Goods must be returned in original, resellable condition with intact packaging.
-
Customised products are non-refundable unless faulty.
-
Faulty customised products will be assessed by AME System Pty Ltd before any replacement is issued.
8. Installation
-
Installation services are available only for the customisable product range and must be quoted separately.

Customers must provide full site details and access requirements prior to quotation.
-
AME System Pty Ltd does not install auxiliary electrical hardware unless otherwise agreed.
9. Cancellation

AME System Pty Ltd may amend or cancel an order before delivery. Customers may cancel without penalty within seven days of receiving notice of amendment.

AME System Pty Ltd is not liable for losses arising from order cancellation.

If a Customer cancels an order, AME System Pty Ltd may charge for costs incurred, including restocking fees.
10. Limitation of Liability

AME System Pty Ltd is not liable for:

Changes in laws affecting the supply of Goods.
-
Consequential or indirect losses.
-
Misuse or mishandling of Goods.
-
Delays caused by factors outside its control, including force majeure events.
-
Incorrect orders placed by the Customer.
